The Terms of Use (“these Terms”) describe the terms and conditions applicable to your use of Panel Consulting Group, LLC services. Panel Consulting Group, LLC, owner of OpinionInsiders.com (the “Site”) has the right to change, edit, add or remove portions of these Terms without prior notice. If you do not agree to these Terms, you should not use or access this Site. You are encouraged to review these Terms every time you use this Site because your use of this Site after any posted changes to our Terms & Conditions is an acceptance by you of these changes. We have the right, without notifying you, to change the products and services available on the Site, and to suspend or discontinue any piece or offer on the Site without notice. We will not be held liable to you or any third party for any suspension, issues, or closing of our Site. At times we may need to limit the amount of use on our Site, and restrict the number of activities you do, or pieces of the site you use or have used in the past.

1. Site Usage

You have access and use of the Site only for your own personal use and in accordance with the terms outlined on this page. The site may not be used for commercial reasons. You are responsible for your own communications, including the transmission, uploading or posting of information, graphics, links, and videos and you are responsible for the consequences of these communications to the Site. We require all Members to agree not to use the Site, and prohibit the use of the Site, for any of the below reasons:

Attempting to interfere in any way with Opinion Insider network security (including phishing, dos attacking, or any other type of hack), or attempting to use the Site’s service to gain unauthorized access to any other computer system.
Posting or communicating any material that infringes on any intellectual property via any piece of our Site.
Posting or sharing any information which is untrue, inaccurate or not your own.
Engaging in conduct that would constitute a criminal offense or give rise to civil liability or otherwise violate any law or regulation.

You are solely responsible for preserving the confidentiality of your account information and password and agree not to share this information. You agree to accept responsibility for all actions that occur under your account. You agree to inform the Opinion Insiders staff immediately if there is any unauthorized use of your account or any other form of security breach.

2. Membership & Incentives

The membership of Opinion Insiders is available to registered users who are 18 years and older, who reside in the United States, and who have not been suspended or removed by Opinion Insiders for any reason (a “Member”). We reserve the right to cancel your membership for any reason at any time including as a result of a violation of these Terms and the Privacy Policy, without notice. Membership is void where prohibited by law. You may accept or decline an invitation to participate in a survey at any time and may only access a survey one time. You agree to provide accurate, and current information about yourself via the registration process and agree to maintain and update your registration information to keep it accurate and complete. Opinion Insiders offers incentives via a point system in exchange for completed and validated surveys and or community activities. The number of points earned for each completed and validated survey or other research activity will vary based on the topic and length of the interview.

In order to redeem rewards from activities on the Site, you must 1) have confirmed your email address by responding to an email sent to you from Opinion Insiders after you registered with us AND 2) completed a minimum of four (4) surveys that have all been validated by the client. A completed survey is defined as a survey that has been legitimately started by the Site, taken by you as a Member, all questions are successfully and truthfully answered, and you have been returned to the Site upon successful completion of the survey or activity. Members who have not completed both 1) and 2) will not be eligible to redeem earned points until both requirements have been satisfied.

Members of the Opinion Insiders Site are allowed to refer friends to the Site and are paid $1.00 per referral. To collect the $1.00 reward, the referred member must complete the initial profiling survey on our website and at least 1 additional paid survey on our Site for the referrer to be paid the $1.00. All referred members are listed in the dashboard of your account. If you notice any discrepancy you may contact support@opinioninsiders.com to discuss. The minimum cash out requirement on the Site is $20.00 USD.

3. Proprietary Rights

You acknowledge and accept that the content (other than member submitted content), materials, text, images, videos, graphics, trademarks, logos, button icons, audio/music, software and other features available on the Site are the property of Opinion Insiders or our licensors and are protected by copyright, trademark or other laws. Except as explicitly authorized by Opinion Insiders you agree not to sell, license, rent, distribute, duplicate, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, modify, reverse engineer or create derivative works from any content or materials on the Site.

4. Content Submission(s)

Opinion Insiders does not own any of the material you make available through the Site. In regards to any materials you submit or make available for inclusion on the Site, you grant Opinion Insiders a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, modify, display, create derivative works, and sublicense such materials or any part of such materials. You hereby agree, warrant and covenant that any materials you provide do not include anything (including, but not limited to, text, images, audio/music or video) you do not have the full right to grant Opinion Insiders the license specified in the preceding paragraph. You further represent, warrant and covenant that any materials you provide will not contain libelous or otherwise unlawful, abusive or obscene material. Opinion Insiders will be entitled to use any content submitted by you without incurring obligations of confidentiality, attribution or compensation to you at any time.

5. Disclaimer & Limitation of Liability

YOU ACCEPT COMPLETE RESPONSIBILITY AND RISK IN REGARDS TO YOUR USE OF THE SITE. THE SITE, AND ALL CONTENT, MERCHANDISE, AND OTHER INFORMATION OR DATA ON OR ACCESSIBLE FROM OR THROUGH THIS SITE OR A “LINKED” SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, SECURITY OR ACCURACY. SINCE SOME STATES DO NOT ALLOW LIMITATIONS ON THE IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, ALL OF THE ABOVE DISCLAIMERS OR EXCLUSIONS MAY NOT APPLY TO EVERY MEMBER.

6. New Terms and Conditions

You agree that new terms and conditions may apply to particular products, services or your use of certain areas of the Site, including the rewards programs (“New Terms”), which New Terms are made part of these Terms by reference. If there is any conflict between these Terms and the New Terms, the New Terms shall control.

7. Indemnity

You agree to indemnify and hold OpinionInsiders.com, Panel Consulting Group, LLC and their affiliates, subsidiaries, agents, directors, officers, representatives, employees, licensors (including third party service providers) and clients harmless from any claims, demands, costs, losses and expenses, including attorneys' fees, made by any person arising out of your violation of these Terms and Conditions, the Privacy Policy, state or federal laws or regulations, or any other person's rights, including but not limited to infringement of any intellectual property right or violation of any proprietary or privacy right.

9. International Use

We control and operate Opinion Insiders from the United States. We make no representation that materials on Opinion Insiders are suitable or accessible for use outside the United States, and advise you to only access it when you are in the United States. If you choose to access this Site from outside the United States, you do so on your own will and are responsible for compliance with that country local laws, if and to the extent local laws are applicable.

10. Copyright Infringement; Contact & Take Down Procedures

Opinion Insiders forbids the posting of any content that is in violation or infringes upon the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity. In the event that you think any material contained on Opinion Insiders infringes your copyright or other intellectual property rights, you should notify us of your copyright infringement claim in accordance with the following procedure. Opinion Insiders will process notices of alleged infringement which it receives and will take appropriate action as required by the Digital Millennium Copyright Act (“DMCA”). This is the Privacy Statement of Panel Consulting Group LLC (hereinafter: ‘PCG’, ‘we’, ‘us’ or ‘our’). This statement outlines how we deal with personal information that is obtained via our platform available at www.opinioninsiders.com (hereinafter: ‘Platform’). We respect the privacy of our users and ensure that any personal information we receive will be protected and treated confidentially. This Privacy policy applies to the online information collection practices of the Panel Consulting Group website, Opinion Insiders, online surveys hosted by PCG, third party survey/service providers, and other products and services provided by PCG. If you access PCG products and services through a link or series of links from other websites or entities, such websites that are not affiliated with PCG; they may have different privacy practices than PCG and PCG is not responsible for the content or policies of these entities or websites.

Registration

The registration process for Panel Consulting Group, LLC at Opinion Insiders is simple. We ask you to fill out a form providing us with certain personal information via our registration form at Opinion Insiders. After you register, we will ask you for additional information through our “Profile Surveys”, which are used to match you with surveys and community activities you may qualify for. Completion of “Profile Surveys” is strictly voluntary; however, we recommend you complete them so you will be invited to surveys and activities that match your demographics and interests. This survey will ask you for information such as your address, phone number, gender, employment status, household income, education level, marital status, household status, ethnicity, and other demographic information that may change from time to time. When you register with Opinion Insiders, you agree: (i) to receive an email from us confirming your registration and agree to click the link in the email to successfully activate yourself on Opinion Insiders; (ii) to receive email invitations asking if you would like to participate in surveys/research activities with links to the surveys/research activities; (iii) when applicable, to receive emails inviting you to participate in voluntary sweepstakes that Opinion Insiders may sponsor for its members; and (iv) to receive email replies to inquiries, comments or updates to your member profile that you submit to the Website. You also agree to the formation of your incentive account which shall be credited after you and/or one of your qualified referrals participate in a survey/research activity that is completed and validated by Opinion Insiders’ staff. In order to register, you need to be a citizen of the United States or you are ineligible to participate. Registrations from areas outside of the United States will not be eligible for membership or earning rewards and will be removed from our system. Use of Information

The data collected during registration enables us to validate your eligibility, to determine which surveys/research activities are applicable to you, and to contact you regarding participation in surveys/research activities or in voluntary sweepstakes that Opinion Insiders may sponsor. We also use individual information to generate demographic data relating to the responses we receive to particular surveys. Survey results are disclosed in the aggregate to the clients of Opinion Insiders who have requested such survey information from us. Our survey results only report aggregate information about demographic groups. Online surveys may reside on servers located at our office, a client site or third party site(s) authorized by Opinion Insiders. Survey responses are identified based upon a survey respondent identification number assigned to each respondent. No personally identifiable information is associated with such survey responses or provided to clients or third parties without the respondents/panelists prior to “opt-in” and/or consent. The individual personal information you provide through the registration process is completely confidential, we never sell it nor do we share it with third parties without your consent (This does not include third party service providers who deliver services essential to the operation and use of the Website and who have agreed to protect the confidentiality of such information that they may have access to as part of their provision of services). Your personal information is also used to credit your incentive account for successfully completed and authenticated surveys and to reward you when you request payment of your incentive balance that is shown to you via your dashboard at Opinion Insiders. Your personal information (including your social security number) may be required for compliance with tax laws and may be disclosed to the appropriate taxing authorities, as required by law. As we are an independent market research company, Opinion Insiders will not use your personal information to sell you any products and or services.

Information Security

Panel Consulting Group takes security seriously and meets or surpasses industry standards and ethics regarding electronic data security and privacy. SSL encryption is used when relevant to the safeguarding of personal information.

Technology & Cookies

This Platform makes use of cookies. A cookie is a small text file that is stored on your computer, tablet or phone via your browser. The cookies we use are essential to the technical operation of our Platform, to give you a better experience on our Platform and to ensure faster and easier use of our Platform. IP addresses, HTTP cookies, browser user agent information, HTML cookies and/or Flash Local Shared Objects (Flash Cookies) may be used at various points of interaction to provide for a better user experience, to safeguard your personal information and to protect the integrity of the data collection process. These and other digital fingerprinting technologies (such as relevant id) are not used to collect data for any means other than the above-mentioned reasons. Under no circumstances are these technologies used to prevent Opinion Insiders members from deleting or removing cookies. Web and application server logs are used solely for security, troubleshooting, support, and maintenance purposes. Google Analytics is used to collect information for site optimization and user statistics but does not collect any personally identifiable information.

Social Networks and Social Media

Opinion Insiders may offer connections to Social Networks to deliver a better experience for our users (Ex. Facebook). These integrations may require verification and the connection of certain information from these Social Networks. PCG will identify such integrations and ask for your permission prior to implementing them.

Consent

In the case that we use your personally identifiable information outside of what is stated in this Privacy Policy, you will be notified over email. You will have the option to accept or deny access to this request by Opinion Insiders.

Update Profile Information

You can correct errors, review and/or update your profile at any time from the profile area of your Opinion Insiders account.

Changes to this Statement

Any information collected via our Platform is covered by this Privacy Statement. We may revise this statement from time to time. If we make a change to this Privacy Statement that, in our sole discretion, is material, we will try to notify you of those changes by posting them on our Platform and/or by sending you an email to the email address associated with your account and we will update the “Last Updated Date” below to indicate when the changes will (or have) become effective. Opt-Out

If at any time you decide that you don't want to participate in our surveys/research anymore, you can unsubscribe. After we have received and processed your request to unsubscribe, you will no longer receive emails from Opinion Insiders inviting you to participate in surveys/research activities. Sweepstakes

Opinion Insiders may hold sweepstakes that are open to current members, new members or to specific subsets of our user base. Partaking in these sweepstakes is voluntary and sweepstakes prize winners will be informed of their prizes via email. Prizes will be deposited in member’s incentive account unless a product needs to be mailed to the panelists’ home. As a condition to entering into such sweepstakes, members agree that Opinion Insiders may use their name, and state for marketing purposes and may display their name, state on this Website for each sweepstake.

Children's Privacy

Opinion Insiders believes in maintaining the security and confidentiality of all visitors to Opinion Insiders, regardless of the person’s age. Opinion Insiders complies with all applicable provisions of the Children’s Online Privacy Protection Act of 1998 (COPPA). Where a parent who is a member of Opinion Insiders has indicated in their member profile that members of their household include children, Opinion Insiders may, from time to time, request that such parent allow one or more of those children to partake in surveys specifically designed for that person. The children of these members may only respond to such surveys on Opinion Insiders by using the email address and password of one of their parents with the prior consent of such parent or guardian. Surveys specifically designed for children to respond to shall relate to products and services that are age appropriate and shall only collect the following general demographic information about the respondent: the child’s age, gender and zip code where the child resides. Surveys shall not collect more personal information about the child than is reasonably necessary for marketing research purposes. The child’s survey responses shall be used for the same purposes and shall be subject to the same obligations, conditions, and restrictions as any other member survey response. By providing an email address and password for the use of Opinion Insiders to any child, the parent has consented to the child’s participation in and response to surveys through Opinion Insiders. Parents have the right to (i) consent to the collection and use of personal information of their children without also consenting to the disclosure of such information to third parties; (ii) review personal information collected from their children; (iii) request that personal information of their children be removed and or deleted; and (iv) refuse the further collection of personal information of their children. In the event a parent believes that their child is using their email address and password to access this Website without authorization, has registered as a member of this Website using false information, or wishes to exercise any of the parental rights set forth in this section, such parent may contact us via our contact us form at Opinion Insiders or via email at support@opinioninsiders.com.

Unsolicited Emails

PCG and Opinion Insiders never spam or send unsolicited emails to its members. Members who send or post spam in order to generate referrals are ineligible for any compensation from Opinion Insiders and will be permanently prohibited from participation in the Opinion Insiders platform. All current and past points will be negated and removed from this members account.

General

By visiting Opinion Insiders, you agree that this Privacy Policy and the Terms and Conditions govern your use of the Opinion Insiders website. All disputes over privacy shall be governed as set forth in this Privacy Policy or in the Terms and Conditions, including applicable law, arbitration rules and limitations on damages.

Disclosure

We may cooperate with government and law enforcement officials or private parties to enforce and comply with applicable laws and regulations. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims, legal process (including subpoenas); (ii) to protect our (intellectual) property, rights and safety and the property, rights and safety of a third party or the public in general; and (iii) to stop any activity that we consider illegal, unethical or legally actionable activity.
